I never cease to be amazed at the success of the anti-constitutionalist and anti-Americanist in moving this nation from an ‘originalist’ to ‘revisionist’ view of the American Constitution. Their success has and is destroying the Republic and the ignorance of most Americans regarding the Constitution is alarming or should be. We are told by liberal activist and even some Republicans who claim to be conservative and constitutionalist that our founding document is too complicated for the masses or layman to understand. That is an attempt, willfully or misguidedly, to keep us ignorant of our most precious national document. That reminds me of antiquity when the masses were kept from reading the Bible and relegated to what they were told it said rather than discovering its precepts for themselves. That produced incredibly dark times in the world and opened the door for unimaginable abuse and evil to spread.
The American Constitution is not difficult and for an incredibly long time all students including those in elementary school studied and understood it. That kept America on a solid foundation and largely keep us afloat as a Republic. Exactly when that erosion began is debatable but the fact that it has been in full bloom for several decades is inarguable and detrimental to our Republic. The Federalist Papers produced by three of our founders, James Madison, Alexander Hamilton, and John Jay were not complicated legal dissertations understood only by astute political scholars and lawyers it was understood by the farmer and average citizen of those times. If you examine what is taught in public schools and listen to the supposedly humorous interviews of the ‘man on the street’ demonstrating the lack of knowledge on this front by the public you know what I’m saying is correct. It has been suggested that 1 in 1000 can name the FIVE BASIC GUARANTEES of our Constitution – freedom of religion, press, speech, assembly, and petition.
Thomas Jefferson’s view was held by the masses for the first 150 years or more regarding Originalism as seen in his explanation to Supreme Court Justice William Johnson. Jefferson said, “On every question of construction, carry ourselves back to the time when the Constitution was adopted, recollect the spirit manifested in the debates, and instead of trying what meaning may be squeezed out of the text, or invented against it; conform to the probable one in which it was passed.” He believed in ‘Original Intent‘ identified as ‘Originalism’. The Constitution says plainly that ONLY the U.S. House of Representatives can initiate a tax increase, not the President, Senate, Courts or any bureaucrat. The Constitution clearly states that “Congress shall make no law respecting an establishment of religion or prohibiting the free exercise thereof.” It gives Congress no power to declare that Prayer in School is unconstitutional for the action of making that declaration is in itself in violation of the 1st Amendment.
The Liberal Leftist Revisionist Activists and Proponents introduced a new philosophy in direct contrast to that of our founders and much of our early history. They advanced the idea that the Constitution was a ‘Living Document’ and advanced the ideas of ‘Pragmatism’, ‘Positivism’ and ‘Progressivism’. To achieve their objective, shredding the constitution and revising it to say what they desired they had to indoctrinate the coming generations to offset and ultimately replace the understanding of the older generation. They sought to instill in the minds that there is no ‘absolute truth’ and that God’s laws or standards are irrelevant in modern times and civil government. That man not God is the source and author of law and highest authority is not God but the government and if the necessary the government must resort to force to enforce the edicts enacted. They advanced the idea that man is an ever evolving creature and therefore Law must evolve as well including the Constitution and that the courts are to make judgments based on that evolution not the original intent or wording of the Constitution.
Men such as Justice Oliver Wendell Holmes, Jr., Louis Brandeis, and Benjamin Cardozo were key figures in the advancement of the idea that societal evolution, not the original intent should be the guide for the courts. That is in direct violation of the constitution which prohibits judges from “making laws”. Their view is fully exposed and expanded in the statement of Chief Justice Charles Evans Hughes, “We are under a Constitution – but, the Constitution is what the judges say it is.” THAT IS DIAMETRICALLY OPPOSITE OF THE INTENT OF THE FOUNDERS! If the ‘original wording’ no longer matters judges are free to strike down long-standing constitutional guarantees and laws and mandate new ones in keeping with their ideology or agenda. We have witnessed and are witnessing the shift from ORIGINALISM to REVISIONISM and we allow it at our own peril. That is why I adamantly argue against any politician regardless of political affiliation who is not an Originalist. I believe the words of George Washington in his farewell address is important for us to remember and heed his warnings. He said, “If, in the opinion of the people, the distribution or the modification of the constitutional powers be in any particular wrong, let it be corrected by an amendment in the way the Constitution designates. But let there be no change by usurpation, for… [This] is the customary weapon by which free governments are destroyed.” WE FAIL TO HEAR and HEED to our own destruction.
Again, November brings us face to face with the real possibility if not probability of a complete shredding of our Constitution and thereby the COMPLETE REVISION of our system of government. There is or should be no argument that Hillary Clinton is a staunch Revisionist and allowing her to expand and advance the agenda of Barack Obama is perilous. Do what you will and say what you please but consider the cost of Hillary Clinton occupying the White House and acting as Commander in Chief of this nation.
