I believe that most Americans think the answer is yes, but the Progressives following the toxicity of liberalism not only do not they do not want them separate.  Washington was embroiled in the confirmation hearings of Judge Brett Kavanaugh and it was nothing short of a side-show.  The Democrats and their protesters attempted to shut down the hearings and derail the nomination.  Their ploy was unsuccessful.  Will the seeming, new found courage and spine of the Republicans last?  I believe that if they have any hope of winning in November or any November they had better learn to stand their ground.

Judge Kavanaugh’s credentials are impeccable and he earned the rating of “well qualified” by the American Bar Association declared.  Imagine that, an organization that is largely left-wing has given him the highest rating they give, yet the Left wants him tossed on the trash heap. Why?  It is not his judicial philosophy.  I do not believe they care about that.  Well, they do because he is not a Liberal Leftist Judicial Activist, but that is not their focus.  Judge Kavanaugh made his judicial philosophy clear in accepting the nomination saying, “My judicial philosophy is straightforward.  A judge must be independent and must interpret the law, not make the law.  A judge must interpret statutes as written.  And a judge must interpret the Constitution as written, informed by history and tradition and precedent.”  That should be what everyone wants, but it isn’t.

The Democrats have attempted to change the judicial and political landscape since FDR’s New Deal.  The modern Democrats desire to change the landscape promoting political and constitutional change through the courts, not legislation.  They want to remove we the people from the equation and prevent the individual states from making decisions.  They want to rule as a tyrannical oligarchy.  The Left doesn’t like Justice Kavanaugh because he has made it clear that he does not believe in judicial activism, a staple of their nominees.

We should heed the words of warning of deceased Justice Antonin Scalia, “This practice of constitutional revision by an unelected committee of nine, always accompanied by extravagant praise of liberty, robs the People of the most important liberty they asserted in the Declaration of Independence and won in the Revolution of 1776: the freedom to govern themselves.”  That is something the Leftist detest for they do not believe that we have the right or ability to make the needed decisions to lead America in the right direction.  They envision themselves as the rightful heirs of rulership and believe they are smarter, wiser, and better equipped to decide for us what is best for us.  I categorically reject that notion!

Bruce Riley Ashford wrote an article for Fox News some time back listed three reasons that Kavanaugh deserves a seat on the Supreme Court.  I list them for you and insert my views on those reasons.  I call upon you to remember that before the Democrats launched their determined fight to block Judge Kavanaugh, Hillary Shelton of the NAACP insisted that Judge Kavanaugh was a “dangerous criminal”.  Senator Jeff Merkley (D-OR) issued the dire warning that Judge Kavanaugh “wants to pave the way to tyranny.”  Senator Cory Booker (D-NJ) called the nomination “alarming.”  Why?  Because Judge Kavanaugh was nominated by Donald Trump and basically no other reason other than He is not a Leftist Judicial Activist Democrat.

Mr. Riley’s reasoned:

  • Judge Kavanaugh’s credentials are impeccable.

They assuredly are impressive.  He earned his law degree from Yale University, clerked for Supreme Court Justice Anthony Kennedy.  He practiced law and was on the staff of Independent Counsel Ken Starr.  He worked as White House staff secretary for President George H.W. Bush.  He earned a partnership in a private law firm and has served on the Circuit Court of Appeals in Washington, DC since 2006. He is not a novice and the incredible request of the Democrats for millions of presidential documents from his tenure on the White House Staff suggests the desperation of the Democrats, trying to find something.  Sounds like their hunt for something on Donald Trump, the president.

  • Judge Kavanaugh’s judicial philosophy is faithful to the Founding Father’s vision.

That is something that I have contended must be embodied in the mindset of any nominee regardless of the party in power and who the president might be at the time.  Legal scholars have agreed that his philosophy views judges as umpires, not players and that is important.  He does not view the Constitution as a living document as do the Leftists of today and many jurists in our modern era.  That view gave us Roe v Wade and many other unconstitutional rulings because they Judges deemed themselves as capable, authorized, and qualified to make an extra-constitutional decision.  I disagree with that philosophy!  They have neither the authority or the right and are bound by the Constitution, as it is written.

  • Judge Kavanaugh’s personal character meets the high standard necessary for serving on the high court.

I lament that some of those now serving do not meet that qualification, so this is a breath of fresh air to this veteran and lover of America.  The allegations and accusations against him would not have survived a court of law because there was no corroboration and there are many things that have come to light that suggest his accuser might have been sexually assaulted but at a later time when she was eighteen, not fifteen and those assaulting her were four boys but none of them Judge Kavanaugh.  There were numerous gaping holes in her accusations.  I am not diminishing her story or her possible trauma, only stating that the requirement of “innocent until proven guilty” must remain a cornerstone of our America system and society.

It is imperative that we have men and women on the Supreme Court whose decisions are not for sale!  There has been vigorous bipartisan support from over 160 members of the Yale community, who have publicly stated they consider Brett Kavanaugh a person of deep conviction and integrity.  What do you do with that Democrats?  The answer has become painfully obvious, they ignore it and continue their assault.

We must deflect the attempt by groups such as Planned Parenthood to create a flammable hysteria in their false demonization of Judge Kavanaugh or any nominee.  This group attempts to champion themselves as the “defender of women’s rights” and the “champions of womankind” but their attacks are and should be an insult to the intelligence of thinking women.  In his time on the bench, Judge Kavanaugh has demonstrated intentional and extraordinary help for women.  Liberal feminist lawyer Lisa Blatt, who has argued more cases before the Supreme Court than any woman told Politico: “Sometimes a superstar is just a superstar.  That is the case with Judge Brett Kavanaugh, who had been considered the most qualified nominee for the Supreme Court if Republicans secured the White House.  The Senate should confirm him.”

His record, qualifications, and character make him an ideal member of the Supreme Court.  What he does on the Supreme Court will define his legacy.  Thankfully the Republicans stood frim firm and hopefully that is a sign of future positioning.  The Democrats should drop their inane arguments and move on to the next order of business and try to find some common ground with the Republicans for the good of the country.  Will they?  Not if recent history is an indication of reality.

I pray that enough Americans will be moved by the divide in Washington and realize the importance of preventing the toxicity of liberalism to regain control of Congress.  I pray millions of otherwise disinterested citizens will go to the polls on November 6th and Vote!  The mismanagement and deviousness of the Democrats to derail Kavanaugh’s confirmation have given me further reason to Vote No on the Democrats in November!
